ABSTRACT
A woman’s struggle to exist as an equal is not unknown. The socio-economic difference in status of woman is often gender-based; and in diversified Indian society, such differences also factor religion based personal laws as key cause. Under the rainbow of secularism, differences among women per se seeps deeper within a religion on the basis of different applicability of personal laws. This paper explores the Muslim Women (Protection of Rights on marriage) Act, 2019 to determine the scope of its ability to address gender equality of a married muslim woman. The study undertakes a doctrinal-analytical approach to identify the technical gaps in the implementation of the provisions while appreciating the bill’s potential to address the mischief of triple talaq.
